These Terms and Conditions ("Terms") govern your access to and use of the website, mobile applications, and EV charging network operated by Saivalabs ("we", "us", or "our"). Please read these Terms carefully before using our Services. By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms.
By visiting our website, registering an account, or using any Saivalabs charging station, you agree to these Terms in their entirety. Your continued use of our Services following any amendment to these Terms constitutes acceptance of the revised Terms. If you do not agree with any part of these Terms, you must immediately discontinue all use of our Services. These Terms apply to all visitors, registered users, host partners, and any other person who accesses or uses the Services.
Access to Saivalabs charging stations is granted solely for the purpose of charging electric vehicles in accordance with the intended design and operating parameters of each charger. When using our network, you agree to the following:
Saivalabs reserves the right to suspend or permanently terminate your access to the network, without refund of any prepaid credits, if you are found to be in violation of these usage rules or if your use poses a risk to the safety of our equipment, other users, or the public.
All pricing displayed at charging stations and on our website and app is inclusive of applicable Goods and Services Tax (GST). Prices are subject to change and the rate applicable at the time your session begins will govern your transaction.
Individuals and organisations interested in hosting a Saivalabs charging station or participating in our investment partnership programme enter into a separate, legally binding Host & Investment Agreement with Saivalabs. The terms of that agreement, including revenue share percentages, deployment timelines, equipment ownership, and exit provisions, are exclusively governed by that document.
We strive to maintain a network uptime of 99.8% across all active charging stations. However, we do not represent or warrant that the Services will be uninterrupted, error-free, or available at any specific time. The following exceptions apply:
All content on the Saivalabs website, mobile applications, and associated platforms — including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof — is the exclusive property of Saivalabs or its licensors and is protected by applicable Indian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from our Services without our prior written consent.
Our Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by applicable law:
You agree to defend, indemnify, and hold harmless Saivalabs and its officers, directors, employees, contractors, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms, your misuse of our Services, your violation of any applicable law or regulation, or your infringement of any third-party rights.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions.
Any legal suit, action, or proceeding arising out of or relating to these Terms or the Services shall be instituted exclusively in the courts of competent jurisdiction in Chennai, Tamil Nadu, India. You waive any and all objections to the exercise of jurisdiction over you by such courts and to the laying of venue in such courts.
Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of 30 days following written notice of the dispute.
Saivalabs reserves the right to modify or replace these Terms at any time. Where we make material changes — that is, changes that substantively affect your rights or obligations — we will provide at least 30 days' advance notice by sending an email to your registered address and by posting a prominent notice on our website and app.
Minor changes, such as corrections of typographical errors or clarifications that do not alter the substance of the Terms, may be made without advance notice, though the "Last updated" date will always be revised. It is your responsibility to review these Terms periodically. Your continued use of the Services after the effective date of any amendment constitutes your acceptance of the updated Terms.
